Deposit agreement in Spain
When you are preparing to buy or sell a property, you will need a deposit agreement to set the sale price of the property. Check the legal status, registration details and any encumbrances on the property
Once you have decided on the property you wish to purchase, we will check the legal and land registry status of the property. This simply involves: verifying who the owners are and whether they match the person selling the property; whether there are any charges on the property, i.e. whether there is an outstanding mortgage; whether there are any tenants; whether there are any debts owed to the residents’ association; checking that the registered floor area of both the property and the plot matches the actual tax records; and finally, checking that the relevant taxes have been paid and are up to date, such as Council Tax or the waste collection charge.
Dealing with a notary in Spain
We take care of all the necessary paperwork with the solicitor’s office so that you only need to attend in person on the day of the formalisation or signing. Alternatively, if you are unable to be in Spain for the formalisation before a solicitor, we can also act as your legal representative to sign on your behalf.
Filing and payment of taxes arising from the sale
Tax advice prior to deciding to buy a property is essential so that you can plan ahead and calculate the taxes you will have to pay. Once the purchase has been completed, we take care of filing and settling the taxes. These usually include VAT or ITP (Value Added Tax or Property Transfer Tax), Stamp Duty, municipal capital gains tax, and capital gains tax, as well as notary and Land Registry fees.

If you wish to carry out any structural alterations to the property, we will also handle the necessary paperwork to ensure they are legally registered. This can be done by submitting a declaration of new-build works or a declaration of existing works, depending on the circumstances. Through this process, we will register the floor area with the Land Registry.
